about child and infant claims
Claims for injured children are different in several ways from claims for adults. There are different time limits for bringing a claim, the Court and/or Public Guardian and Trustee must approve the settlement, and an adult must act as a “litigation guardian” for the child. In addition, waivers that are commonly used to defeat adult claims, are not enforceable against children, even when signed by their parent or guardian.
